The article "Totalitarian state and the free economy: on the conditions of freedom in the trials of German industrialist" (only available in German) has now been published open access by the Zeitschrift für Friedens- und Konfliktforschung (ZeFKo).
In her article, Hannah Franzki analyzes the economic-political conception of order that underlies the legal argumentation in the charges of aggressive war, slave labor and plunder. The central argument here is that the trials are part of the social process in which the conditions of a liberal post-war order are negotiated. Similar to ordoliberal theories, they locate the cause of the crimes where the state violates the supposedly free sphere of the economy.
The text is part of the Special Issue on "Transnational Corporations and Conflict" (forthcoming), co-edited by Hannah Franzki, Carolina Vestena and Christian Scheper.
